SIDS – It is just about Impossible to Sue that Vaccines Cause SIDS, Even if it's Clear as Day!
The Case of Chase Boatmon and Maurine Cupid v. Secretary of Health and Human Services.
There has never been a case to my knowledge in which a parent was able to collect a claim that a vaccine caused their infants sudden death.
Here is a case in which the Special Master found that “J.B.’s Sudden Infant Death was caused by Vaccines.
In the “Vaccine Court”, which is a court for the National Vaccine Injury Compensation Program, a Special Master is appointed to act like a Judge in adjudicating the vaccine injury claim.
In the case of “Boatman and Cupid v. Secretary of Health and Human Services (U.S. Court of Appeals for the Federal Circuit, Nov. 7, 2019)” – the “Special Master” determined that Vaccines did in fact cause the SIDS death of J.B. and the petitioners were entitled to compensation.
Boatmon and Cupid v. Secretary of Health and Human Services (U.S. Court of Appeals for the Federal Circuit, Nov. 7, 2019)1:
The U.S. Court of Appeals for the Federal Circuit affirmed a lower court decision finding that the parents of a child who died from Sudden Infant Death Syndrome (SIDS) failed to prove that vaccinations caused the child’s death.
The infant, J.B., died of SIDS 2 days after receiving typical childhood vaccines.
The National Vaccine Injury Act allows recovery for certain injuries established as causally related to vaccines.
SIDS is not listed on the act’s Injury Table.
Recovery under the act is only allowed for other injuries if one proves a vaccine caused the injury.
After trial, the Special Master found that the vaccines caused J.B.’s death from SIDS.
The U.S. Court of Federal Claims reversed that decision.
On appeal, the Federal Circuit upheld the reversal.
The U.S. Department of Health and Human Services’ experts testified that there is no evidence linking vaccines to SIDS in general and no evidence linking vaccination to J.B.’s death.
Although the plaintiff’s expert testified that there was a causal link, the court found that the testimony was unsupported by “reputable medical or scientific explanation.”
Are you beginning to see how difficult it is to sue the US Government?
There is NO Jury involved.
The initial trial ruled that vaccines did cause the SIDS death of J.B.
Then it was appealed by the US Gov and of course it was Reversed.
This reversal was appealed but the reversal was upheld.
CASE OVER.
You can thank the 1986 National Childhood Vaccine Injury Act which completely removed liability from the vaccine manufacturers and put it in the US Governments hands and put significant limitations on the payouts.
That is when vaccine makers went to the government and begged for an indemnification to move the liability from them to the government because they were getting sued too much.
This was one of the worst acts in history and from this point, Autism Rates skyrocketed and today as RFK Jr. – Secretary of Health says – 1 in 31 children are diagnosed with Autism and 1 in 18 boys.
These cases must be in front of a Jury and the 1986 National Childhood Vaccine Injury Act needs to be trashed and the liability needs to be put back the ones who are liable, the vaccine manufacturers.
It is very unfortunate that SIDS is not listed on the National Vaccine Injury Acts Injury Table because Dr. Paul Thomas says that 97% of SIDS occurs one week AFTER Vaccination, not BEFORE.
Maybe it should be called "Vaccine Death Syndrome."
One would think that the CDC may pay attention and follow these statistics but they don’t.
Instead they revoked Dr. Thomas’ medical license and labeled him an Anti-Vaxxer.
It is an uphill battle for parents who recognize that vaccines are injuring, disabling and killing children.
The answer they receive is “the science indicates no links between vaccines and autism and vaccines and SIDS.”
Maybe it’s time to just use our EYES.
Seeing is believing until the “science” proves that what you are seeing is NOT really what you are seeing.
